O. Reg. 34/15 (Order Under Subsection 17 (10) of the Act) amended O. Reg. 699/98 (Order Under Subsection 17 (10) of the Act) under the Planning Act. The amendment permits Northumberland County to exempt official plan amendments in the Town of Cobourg, Municipality of Port Hope and Municipality of Trent Hills from its approval, once the County Official Plan comes into effect.

O. Reg. 34/15 (Order Under Subsection 17 (10) of the Act) made under the Planning Act came into force on February 27 2015.

Summary of Proposal:
This would have the effect of giving the council of Northumberland County the power to exempt all or some official plan amendments of the Town of Cobourg, Municipality of Port Hope and Municipality of Trent Hills from its approval. O. Reg. 525/97 currently exempts official plan amendments of these municipalities from the Minister's approval.

It is proposed that Northumberland County would receive its new authority on the date the regulation is filed, although no by-law under this authority would have effect until the new County Official Plan is approved and all or part of it is in effect.

Purpose of Regulation:
The Province is committed to a sound, efficient and effective planning system that enhances local autonomy and streamlines decision-making on planning applications.

This proposed regulation would authorize the council of Northumberland County to exempt all or some official plan amendments in the Town of Cobourg, Municipality of Port Hope and Municipality of Trent Hills from County approval, once the County Official Plan comes into effect. This authorization would, subject to the discretion of the County, allow these municipalities to maintain their current approval powers; while recognizing that the County will become their planning approval authority rather than the Minister of Municipal Affairs and Housing, once a County Official Plan is in place.
