Summary of Decision:
On June 17, 2015 the Ontario Farm Products Marketing Commission amended O. Reg. 208/09 (Tobacco - Powers of Local Board), made under the Farm Products Marketing Act, to revoke redundant regulatory authorities now that the Ministry of Finance has assumed the responsibility for licensing tobacco production in Ontario.

The amendments revoke the majority of the OFCTGMB's marketing authorities. Authorities that remain include the ability to stimulate the marketing and promotion of tobacco, provide voluntary services, and charge fees for services requested by producers. The amended regulation retains a provision requiring the Commission to approve any expenditure in excess of $25,000.

The amendments to O. Reg. 208/09 became effective on July 27, 2015.

Ontario Regulation 208/09 (Tobacco - Powers of Local Board) outlines the authorities of the Ontario Flue-Cured Tobacco Growers' Marketing Board (OFCTGMB). The regulation delegates OFCTGMB the authority to license producers, collect licence fees and service charges, and seize and detain tobacco.

As of January 1, 2015, the Ministry of Finance assumed responsibility for licensing tobacco producers and tobacco production in Ontario through Ontario Regulation 247/14 made under the Tobacco Tax Act.
