Summary of Decision:
On September 17, 2015 the Ontario Farm Products Marketing Commission (Commission) amended R.R.O. 1990, Regulation 440: Vegetables for Processing - Marketing, made under the Farm Products Marketing Act, to revise some of the deadlines in the negotiation Schedule, and to provide flexibility in deadlines to the negotiating parties should they be able to reach agreement on a new deadline and inform the Commission in writing by a specific time. The amendments allow for parties to extend negotiations for up to three business days. The amendments also allow for separate negotiating schedules for the hand harvest and machine harvest cucumber crops.

The amendments to Regulation 440 became effective on October 15, 2015.

Summary of Proposal:
Regulation 440 (Vegetables for Processing - Marketing) contains a schedule of deadline dates for the various crop negotiations that take place between the OPVG and processors / green shippers.

These dates are fixed by regulation and do not provide any flexibility for changing dates because of scheduling issues or industry events.

The amendments to Regulation 440 would update the current negotiation Schedule in the regulation and provide additional flexibility where the parties agree to a different negotiation date.

Regulation 440 is a Commission made regulation which the Commission has the authority to amend.
