Summary of Decision:
Regulation 47/10 (Penalties) has been amended effective November 26, 2015 to align with the expanded scope of the Employment Protection for Foreign Nationals Act, 2009 (EPFNA) that came into force on November 20, 2015 pursuant to Stronger Workplaces for a Stronger Economy Act, 2014 (Bill 18). The EPFNA previously only applied to live-in caregivers, but beginning November 20th it extended protection to all foreign nationals who, pursuant to an immigration or foreign temporary employee program, are employed in Ontario or attempting to find employment in Ontario. Prior to the consequential amendment, Regulation 47/10 was inconsistent with the EPFNA and limited certain penalty multipliers to "live-in caregivers". This limitation was removed to ensure that the regulation was harmonized with the expanded EPFNA.
