Summary of Proposal:
The Minister of Municipal Affairs is proposing to make a regulation under the Municipal Act, 2001 to prescribe subject matters required to be included in local codes of conduct.

On March 1, 2019, the date named by proclamation, the Modernizing Ontario's Municipal Legislation Act, 2017 will require municipalities to have a code of conduct for members of council and certain local boards and will provide the Minister of Municipal Affairs with regulation-making authority to prescribe one or more subject matters required to be included in codes of conduct.

As background, it is generally up to municipalities to determine the contents of local codes of conduct. This would include determining how to address prescribed subject matters described below.

The proposed regulation would prescribe the following subject matters that a municipality would be required to include in the codes of conduct for members of the council of the municipality and of its certain local boards:

-Gifts, benefits and hospitality.
-Respectful conduct, including conduct toward officers and employees of the municipality or the local board, as the case may be.
-Confidential information.
-Use of property of the municipality or of the local board, as the case may be.

In addition to these proposed prescribed subject matters, municipalities may also wish to consider other matters to include in local codes of conduct.

The regulation would come into force on March 1, 2019.
