Summary of Decision:
This amendment extends the revocation date of section 6.2 of O. Reg. 329/04 under PHIPA to January 1, 2020. Without the amendment, section 6.2 would have otherwise been revoked on January 1, 2018, leaving a gap in the privacy framework under which eHealth Ontario creates and maintains the electronic health record.

The Health Information Protection Act, 2016 (HIPA) received Royal Assent on May 18, 2016. It establishes privacy rules for the shared Electronic Health Record (EHR). The Ministry of Health and Long-Term Care is undertaking the work required to proclaim into force the provisions of HIPA related to the EHR. If proclaimed into force, the new legislative framework will permanently replace section 6.2 of Ontario Regulation 329/04.
