Summary of Decision:
The Industrial Establishments Regulation, made under the Occupational Health and Safety Act, has been amended to add a new, targeted exemption from guardrail requirements as well as a requirement for employers to develop and implement other measures and procedures to protect workers from the hazard of falling where any of the guardrail exemptions apply.
Analysis of Regulatory Impact:
Businesses may incur minimal administrative costs to learn about the regulatory amendments.

The new exemption to guardrail requirements in section 13 of the Industrial Establishments Regulation will not create additional costs for vehicle and vehicle parts manufacturers. The new requirement to develop and implement other measures and procedures to protect workers from the hazard of falling where a business has used an exemption to guardrail requirements is not expected to increase costs to business, as clause 25(2)(h) of the Occupational Health and Safety Act already requires employers to take "every precaution reasonable in the circumstances" to protect workers.
