Enforcement of Small US Commercial Vehicles with No Permits for travel in Ontario

Summary of Proposal:
This proposal is to amend the Highway Traffic Act (HTA) Regulation 628-Section 15 to allow small U.S. commercial trucks that do not qualify for registration under IRP to be exempt from requiring permanent or temporary Ontario registration. This regulatory amendment would make registration requirements for these vehicles consistent with requirements currently being applied to Ontario based vehicles in US jurisdictions.

The amendment will also be removing various specific, historic exemptions within the regulation. These exemptions are being replaced with the simple principle that we will treat US small commercial vehicles the same as Canadian.
Analysis of Regulatory Impact:
U.S. Commercial vehicles not requiring trip permits would not be fined, saving these carriers both time and potential fine charges which could range between $60-1000. Also, cost of trip permits for these vehicles would typically be as follows:
o Laden commercial vehicle (gross weight over 4500 kgs) or bus, without trailer: $114
o Laden commercial vehicle or bus, towing a trailer: $201
