Summary of Proposal:
The government is proposing to add exemptions from the ESA for "wilderness guides". "Wilderness guides" would be defined and exempted from hours of work, overtime pay, and public holidays provisions, same as the exemptions that currently apply to fishing and hunting guides under the ESA. These employees would also be subject to special minimum wage rates, which are proposed to be the same rates that currently apply to fishing and hunting guides. The current rates that apply to fishing and hunting guides are: $70.00 for less than five consecutive hours in a day and $140 for five or more hours in a day, whether or not the hours are consecutive. The proposed changes are not anticipated to have any administrative costs for business.
