Summary of Proposal:
The Ministry of Energy, Northern Development and Mines (ENDM) is proposing amendments to O. Reg. 429/04, the Global Adjustment (GA) regulation, to recognize legacy, regional cogeneration facilities that predate the implementation of the regulation and that make use of the Independent Electricity System Operator (IESO) controlled grid (i.e., a bulk transmission system) in the delivery of electricity. Under these proposed amendments, generation from these legacy cogeneration facilities dedicated to specific customers of the regional cogeneration facility would be accounted for as deemed behind-the-meter generation in the calculation of customers' peak demand factors in order to ensure that costs are not inappropriately accounted for in establishing their liability for Global Adjustment. Eligible cogeneration customers would be required to show that the generation from the legacy cogeneration facility is dedicated exclusively to their load facility.
