Summary of Proposal:
It is proposed that the contingency fees regulation under the Solicitors Act be amended so that the requirements listed in the regulation for what must and must not be included in a contingency fee agreement are replaced with a mandatory standard form contingency fee agreement. There would be exemptions from having to use the standard form contingency fee agreement for sophisticated clients and where a court has approved the agreement.
