Amendments to O. Reg. 306/09 (Tobacco - Plan) and O. Reg. 208/09 (Tobacco- Powers of the Local Board) under the Farm Products Marketing Act

Summary of Decision:
At the request of the Ontario Flue-Cured Tobacco Growers' Marketing Board (OFCTGMB), the Ontario Farm Products Marketing Commission (Commission) amended two regulations under the Farm Products Marketing Act:

•O. Reg. 306/09: Tobacco - Plan, to update the composition of OFCTGMB from one that is Commission appointed to one that is elected by producer members.

•O. Reg. 208/09: Tobacco - Marketing, to:
•Establish a licensing system for producers of tobacco
•Provide OFCTGMB with the authority to set and collect licence fees from its producer members.

The Regulations were filed with the Registrar of Regulations and are now in effect.
Analysis of Regulatory Impact:
There are no compliance or new administrative costs associated with the amendments to O. Reg. 306/09: Tobacco - Plan, which change the composition of the Ontario Flue-Cured Tobacco Growers' Marketing Board (OFCTGMB).

The amendments to O. Reg. 208/09: Tobacco - Marketing, which provide the OFCTGMB with the ability to collect licence fees, will provide the board with the financial resources they need to support Ontario's tobacco sector through research, advocacy and market development. The fees will also enable the board to represent and advocate on behalf of producer members on issues such as production insurance, business risk management, farm labour and pesticide registrations. The direct compliance cost for producers is considered minimal as producers were required to pay licence fees up until 2015 and paying a licence fee is in keeping with agricultural production sector norms. OFCTGMB consulted its producer members regarding these amendments and support was indicated. There are no new administrative costs associated with these amendments.

There are no direct compliance cost-savings from these regulatory amendments.

Summary of Proposal:
At the request of the Ontario Flue-Cured Tobacco Growers' Marketing Board (OFCTGMB), the Ontario Farm Products Marketing Commission (Commission) is proposing amendments to:

• O. Reg. 306/09 (Tobacco - Plan), which would update the composition of OFCTGMB's board from one that is Commission appointed to one that is elected by producer members.
• O. Reg. 208/09 (Tobacco - Powers of the Local Board), which would provide OFCTGMB with the authority to set and collect licence fees from its producer members. The proposed licence fee amount is $4 per acre.

O. Reg. 208/09 (Tobacco- Powers of the Local Board) is a Commission-made regulation, which the Commission has the authority to amend. Amendments to O. Reg. 306/09 (Tobacco- Plan) are made by the Commission, subject to approval by the Minister of Agriculture, Food and Rural Affairs.
