Summary of Decision:
Regulations have been updated to include references to the Safe Food for Canadians Act. Updating these regulations will reduce the risk of confusion and help businesses understand what requirements apply in Ontario.

The ministry has also removed duplicative record-keeping requirements for inedible egg shipments from federally inspected egg grading and egg processing stations.

The following regulations have been amended:

Summary of Proposal:
The proposed amendments are intended to update outdated references to the new federal legislation and regulations as well as removing duplicative provincial oversight requirements of inedible egg shipments from federally-inspected egg grading and egg processing stations.

The federal Safe Food for Canadians Act was passed in 2012 and largely came into force on January 15, 2019. The law consolidates the former federal Fish Inspection Act, the Meat Inspection Act, the Canada Agricultural Products Act and the Consumer Packaging and Labelling Act into a modernized regulatory framework. Currently, Ontario's regulations are aligned with and refer to Canada's former food safety legislation and regulations.

When the federal government changed their framework to the Safe Food for Canadians Act and the Safe Food for Canadians Regulations in January 2019, the references in OMAFRA's regulations and alignment between them and the federal scheme became outdated. As a result, OMAFRA is proposing updates to references in eight provincial regulations:

Updating outdated references would reduce the risk of confusion and help businesses understand what requirements apply in Ontario.

In addition, the Ministry is proposing to remove duplicative provincial oversight requirements of inedible egg shipments from federally inspected egg grading and egg processing stations. O. Reg. 171/10 - Eggs and Processed Egg under the FSQA currently requires records for the shipping of inedible eggs, and inedible processed egg from the premises of federally inspected egg grading and egg processing stations because previous federal legislation before the SFCA did not. The SFCA and Regulations now include adequate oversight; the new regulations under the SFCA will continue to provide for verification that inedible egg does not enter the human food chain.
