Amendments to O. Reg. 316/03 Regarding Off-Road Vehicle Access on Municipal Highways

Summary of Proposal:
The proposed regulatory amendments would allow all approved types of off-road vehicles to operate on all municipal roads unless a by-law restricts or prohibits some or all vehicle types or restricts or prohibits ORV access to some or all roads under municipal jurisdiction. The municipalities that the proposed amendments will apply to are listed in Ontario Regulation 8/03, made under the Highway Traffic Act.

Affected municipalities will be able to opt out by passing a by-law to restrict or prohibit off-road vehicle access on some or all roads under their municipal jurisdiction.

In addition, regulatory amendments would ensure that highways referred to in Schedules 1 and 2 of Regulation 863, made under the Off-Road Vehicles Act, are the same as highways referred to in Schedules A and C in Ontario Regulation 316/03. Schedules 1 and 2 from Regulation 863 would be revoked and a cross-reference made to Schedule A and C in Ontario Regulation 316/03.
Analysis of Regulatory Impact:
The proposed amendments will not impose additional burdens or costs for businesses.
