Summary of Proposal:
The Rules of the Small Claims Court have been amended to:
• create a new rule, r. 1.05.3, to consolidate and centralize the rules authorizing the use of the Small Claims Court E-Filing Service Portal to electronically file and/or issue certain court documents in a Small Claims Court proceeding and clarify processes;
• introduce a new rule, r. 1.05.4, to authorize the use of the new Small Claims Court Submissions Online Portal to electronically submit documents to request filing and/or issuance in a Small Claims Court proceeding;
• identify the documents that may be filed and/or issued through the Small Claims Court E-Filing Service Portal and the Small Claims Court Submissions Online Portal;
• remove the requirements to submit a paper copy of documents that are filed electronically through the Small Claims Court E-Filing Service Portal.
The regulation amends 12 rules and creates 2 new rules.
