Summary of Decision:
O. Reg. 104/96 (Regulation) under the Health Care Consent Act, 1996 (HCCA) has been amended effective January 1, 2011. The amendments to the Regulation reflect the amendments made to the HCCA by the Regulated Health Professions Statute Law Amendment Act, 2009 (Bill 179) to add a Registered Dietitian as an evaluator in the circumstances set out in the regulations.

Summary of Proposal:
The HCCA was recently amended by the Regulated Health Professions Statute Law Amendment Act, 2009 (Bill 179) to add a member of the College of Dietitians of Ontario as an evaluator of capacity in the circumstances prescribed by the regulations. It is proposed to amend Regulation 104/96 under the HCCA concerning evaluators to add a member of the College of Dietitians of Ontario as an evaluator for the purpose of determining whether a person is capable of making a decision about admission to a care facility (a long-term care (LTC) home under the Long-Term Care Homes Act, 2007) and about personal assistance services provided to a resident of a care facility.
