Spring 2022 Red Tape Reduction Package - proposed Building Ontario Businesses Initiative Act (Fewer Fees, Better Services Act, 2022)

Regulation Number(s):
N/A
Instrument Type:
Act
Bill or Act:
Building Ontario Businesses Initiative Act
Summary of Proposal:
Public sector procurement can play an important role in economic development by creating more opportunities for economic growth. This is particularly important as Ontario and Canadian businesses are currently struggling to recover from the impacts of the COVID-19 pandemic.

The proposed Building Ontario Businesses Initiative Act (BOBIA), as part of the Spring 2022 Red Tape Reduction Act, requires public sector buyers to give preference to Ontario businesses when conducting procurement processes for goods and services under specified threshold amounts.
With the proposed BOBIA legislation, the Lieutenant Governor in Council is given regulation-making authority.

If passed, the BOBIA would provide greater opportunities for growth for Ontario businesses through public procurement, potentially increasing the economic impact of the government's procurement spending in the province.
Analysis of Regulatory Impact:
The proposed legislative amendments would not add regulatory requirements or additional costs for businesses.

Rather, the proposed BOBIA legislation gives the Lieutenant Governor in Council (LGIC) regulation-making authority.

The development and posting of the proposed Regulation on the details of the requirement(s) is to-be-determined and is subject to when BOBIA is Proclaimed and in-force.
