Summary of Decision:
A Board Regulation was made under the Ontario College of Trades and Apprenticeship Act, 2009.

The Regulation sets out the criteria and process to be used in determining the appropriate journeyperson to apprentice ratio for a trade and in determining the classification or reclassification of a trade as a compulsory trade or a voluntary trade.

The determination of ratios and trade classifications will be made by Review Panels. Each Review Panel will be made up of three members selected from a roster of adjudicators appointed by the College of Trades Appointments Council. One member of a Review Panel will be appointed by the Board of Governors of the Ontario College of Trades and two members will be appointed by the Divisional Board for the sector to which the trade belongs.

Ontario Regulation 458/11 (Reviews Under Part IX of the Act) was filed with the Registrar of Regulations on November 4, 2011 and was published on e-laws on November 8, 2011, and in the Ontario Gazette on November 19, 2011.

Summary of Proposal:
The Ontario College of Trades (OCoT) is responsible for governing the apprenticeship and skilled trades system in Ontario in accordance with the Ontario College of Trades and Apprenticeship Act, 2009.

Under the Act, the Ontario College of Trades may make Board regulations on a variety of subject matters, including the criteria and process for determining journeyperson to apprentice ratios and determining classification of trades as compulsory or voluntary, subject to prior review by the Minister of Training, Colleges and Universities and the approval of the Lieutenant Governor in Council.
