Analysis of Regulatory Impact:
The Ministry of Tourism, Culture and Sport does not anticipate any business impacts related to the proposed regulation.

There are no direct compliance costs to business associated with the proposed regulation, which would not impose any:

• administrative costs;

• upfront capital costs; or

• upfront or ongoing capital costs.

The proposed regulation would enable the establishment of the Ontario Combative Sport Advisory Council, which would provide the Minister with advice on future regulations regarding the conduct of amateur and professional combative sport.

As part of its obligations under the Reducing Regulatory Cost for Business Act, 2017 (RRCBA), the ministry would conduct a Regulatory Impact Analysis (RIA) on any of these future regulations under the CSA, to assess the benefits and costs to business in Ontario.

Summary of Proposal:
Provisions in the Combative Sports Act, 2019 (CSA) provide for the establishment of the Ontario Combative Sport Advisory Council (the Advisory Council). If those provisions are brought into force, the Advisory Council would be established.

Under the CSA, the Advisory Council would provide advice to the Minister responsible for the Act on regulations that the Minister may make, including:

(1) setting out sports that are combative sports, for information purposes;

(2) governing the conduct of amateur and professional combative sport contests or exhibitions, including prescribing rules relating to such contests and exhibitions;

(3) governing fees and eligible expenses for officials appointed by the Commissioner for any professional combative sport contest or exhibition;

(4) allowing the Minister to exempt an amateur or professional combative sport contest or exhibition from the rules set out in (2) that apply to the combative sport, provided that the Minister is satisfied the contest or exhibition satisfies any requirements set out in regulation; and

(5) requiring a person wishing to promote, conduct or hold an amateur or exhibition or professional combative sport contest or exhibition in a particular combative sport to obtain the Minister's approval of rules that will apply to the contest or exhibition where no regulation is made under (2).

The proposed regulation, attached for comments, sets out details related to the Advisory Council in addition to those already in the CSA and would:

(1) enable the appointment of not more than seven members to the Advisory Council for an initial term of up to three years and reappointment for any number of additional terms of up to three years;

(2) set out voting procedures for the Advisory Council; and

(3) set out two additional functions of the Advisory Council that are not otherwise described in the CSA, specifically:

(i) advising the Minister whether the rules submitted to the Minister for the conduct of an amateur combative sport contest or exhibition allow for full contact; and

(ii) any other function or provide any other advice necessary to facilitate the Minister's administration of the Act.
