Summary of Decision:
Following a request from the Ontario Sheep Marketing Agency (OSMA), the Ontario Farm Products Marketing Commission (Commission) made an amendment to Reg. 430: Sheep - Plan, that:

•introduced director term limits which allow a producer in a district to be elected as a member of the board for three consecutive three-year terms (i.e. nine years) after which the producer must take a mandatory break in service before being eligible again for election, and
•changed the board's name from Ontario Sheep Marketing Agency to Ontario Sheep Farmers.

A consequential amendment to the name of the board in Reg 429: Sheep - Marketing was also made.

Reg. 430 also required housekeeping amendments that removed outdated references to the Co-operative Corporations Act, updated the geographic references to align with the Territorial Division Act, and translated the regulation into French. These updates did not change the intent of the original posting.

The Commission has the authority to make amendments to Reg. 430, subject to approval by the Minister of Agriculture, Food and Rural Affairs. Reg. 429 is a Commission-made regulation, which the Commission has the authority to amend.

The Regulations were filed with the Registrar of Regulations and are now in effect.
Analysis of Regulatory Impact:
There are no anticipated direct compliance costs associated with the amendments to Reg. 430 and Reg. 429. There are no new administrative compliance costs to the board, the producers or government. There are no direct compliance cost-savings from these regulatory amendments.

Summary of Proposal:
Following a request of the Ontario Sheep Marketing Agency (OSMA), the Ontario Farm Products Marketing Commission (Commission) is proposing an amendment to Regulation 430: Sheep - Plan under the Farm Products Marketing Act which would introduce member term limits. Under Reg. 430, producer members are elected to the board for a term of three years with no limit on the number of consecutive terms a producer member can serve. The proposed regulatory amendment would allow a producer in a district to be elected as a member of the board for three consecutive three-year terms (i.e. nine years) after which the producer must take a mandatory break in service equivalent to one term (i.e. three years) before being eligible again for election.

OSMA has also requested a change in the board's name from OSMA to "Ontario Sheep Farmers" (OSF). OSMA registered OSF under the Business Names Act on March 1, 2017. OSMA carries on business and is commonly known as OSF but is required to use both names in certain circumstances such as on all contracts and invoices. Therefore, it is preferable to change the name of the board within the regulation for clarity and consistency. A consequential change to the name of the board in Regulation 429: Sheep - Marketing is also required.
