Summary of Proposal:
Currently, there are provisions in the Services and Supports to Promote the Social Inclusion of Persons with Developmental Disabilities Act, 2008 ("the Act") that are not yet in force relating to direct funding and the introduction of a new funding approach.
The Ministry of Children, Community and Social Services ("the Ministry") is proposing to re-enact and change the date on which these unproclaimed provisions come into effect from "July 1, 2023" to "a day to be named by proclamation of the Lieutenant Governor".
The Ministry is also proposing to repeal and re-enact section 38(q) of the Act, with minor amendments. These amendments would enable regulations respecting any transitional matters that the Lieutenant Governor in Council considers necessary or advisable to effectively implement the Act and its regulations.
The Ministry is also proposing to add section 38.1 to the Act. This change is intended to provide the Lieutenant Governor in Council with regulation-making authority respecting transitional matters intended to permit the gradual implementation of the re-enacted provisions.
The proposed changes would come into force upon Royal Assent of the Ministry of Red Tape Reduction Omnibus Bill.
Analysis of Regulatory Impact:
There would be no new administrative or compliance costs, burden or requirements as a result of the proposed legislative amendments. The proposed amendments would not create any new costs to government.
