Summary of Proposal:
R.R.O. 1990, Reg. 565: Public Pools ("Regulation") under the Health Protection and Promotion Act sets out requirements and standards for operations, maintenance and equipment at public pools and public spas.

Currently, the Regulation requires all lifeguards, assistant lifeguards, and aquatic instructors/coaches to be at least sixteen (16) years of age.

If approved, the proposed amendment would lower the legal age requirement for lifeguards, assistant lifeguards and aquatic instructors/coaches to be fifteen (15) years of age.

This change is intended to address staffing shortages and retention issues in the aquatic sector. This will also align the Regulation with recent changes to eligibility requirements for the Lifesaving Society National Lifeguard Service Certification Course.

Ontario is reducing regulatory burden for owner/operators of aquatic facilities and is promoting employment opportunities for Ontario's youth. The proposed change also supports greater access to lifeguard-supervised public pools and swimming lessons across the province.

All interested parties or individuals are encouraged to provide feedback on the proposed amendment.
