Summary of Decision:
Approved amendments to the regulations made under the Ontario Drug Benefit Act (ODBA) and the Drug Interchangeability and Dispensing Fee Act (DIDFA) to support the changes to Ontario’s drug system.

Part of the approved changes is the implementation of a reward period for generic manufacturers beginning April 2012, that are able to bring a product to market sooner as a result of a successful patent challenge.

The approved regulation states that the price of generic products that meet this reward period should be to a maximum of 35 per cent. The new regulation will include a maximum of 50 per cent.
