Summary of Decision:
Following a request of the Ontario Greenhouse Vegetable Growers (OGVG), the Ontario Farm Products Marketing Commission (Commission) made an amendment to Reg 418: Greenhouse Vegetables - Plan which provided the board with authority to appoint a non-voting chair, who is not required to be a producer of greenhouse vegetables.

A consequential amendment to Reg 400: By-Laws for Local Boards was also made to clarify that certain provisions within that regulation related to chairs of local boards do not apply to a non-voting chair appointed under Reg. 418.

The Commission has the authority to make amendments to Reg. 418, subject to approval by the Minister of Agriculture, Food and Rural Affairs. Reg. 400 is a Commission-made regulation, which the Commission has the authority to amend.

The Regulations were filed with the Registrar of Regulations and are now in effect.
Analysis of Regulatory Impact:
There are no anticipated direct compliance costs or cost savings associated with the amendment to Reg 418.

Summary of Proposal:
Following a request from OGVG, the Ontario Farm Products Marketing Commission (Commission) is proposing amendments to Reg 418: Greenhouse Vegetables - Plan under the Farm Products Marketing Act.

Under the current regulatory framework, the Commission appoints a non-voting chair to the board who is not a producer of greenhouse vegetables. The amendments, if made, would give OGVG the authority to appoint its own non-voting chair. The appointed chair is not required to be a producer of greenhouse vegetables.

The Commission has the authority to make amendments to Reg 418, subject to the Minister's approval.

Should the amendments proceed, a consequential amendment to Regulation 400: By-Laws for Local Boards will be required which will clarify that provisions within that regulation related to voting by the chair of a local board do not apply to a non-voting chair appointed under Reg. 418.
