Amending Regulation 525/10 was filed with the Registrar of Regulations on December 21, 2010. Regulation 402 (Chicken – Marketing) has been amended to authorize the establishment of a “Chicken Industry Advisory Committee” with representation from Chicken Farmers of Ontario, the Association of Ontario Chicken Processors and from the Ontario Farm Products Marketing Commission.

Summary of Proposal:
The Ontario Farm Products Marketing Commission (“Commission”) is a regulatory agency of the Government of Ontario, established under the Ministry of Agriculture, Food and Rural Affairs Act. The Commission has a range of regulation making powers under the Farm Products Marketing Act (FPMA) that pertain to Ontario’s regulated marketing sector, which includes chickens.

Under paragraph 23 of subsection 7(1) of the FPMA, the Commission has regulation making authority “… providing for the establishment of advisory committees that may be empowered to advise and make recommendations to the local board…”. The local board in this case is the Chicken Farmers of Ontario (“CFO”)

The proposed amendment to the regulation would allow for the formation of an industry advisory committee known as the “Team Ontario Partnership Steering Committee” (TOPSC). The committee membership would be comprised of CFO, the Association of Ontario Chicken Processors (AOCP) and the Commission. As the name indicates, the proposed advisory committee could only advise the CFO on issues; it would have no regulatory or decision-making authority.

TOPSC could advise and make recommendations to the CFO on a variety of topics, including;
- the promotion of good relations between chicken industry players;
- promotion of greater efficiency in the production and marketing of chickens;
- preventing and correcting issues in the marketing of chickens;
- improving the quality and variety of chickens;
- improving the circulation of market information about chickens;
- other matters related to issues that the CFO has regulatory authority to address.

The proposed committee would have the potential to improve overall industry relationships and to advance the sector to the benefit of all parties.
