Summary of Proposal:
The Ministry of Children, Community and Social Services (MCCSS) is proposing to amend the Child, Youth and Family Services Act, 2017 (CYFSA) to improve the everyday experiences of children and young persons in children's licensed residential settings by strengthening MCCSS monitoring and oversight of licensed settings, by enhancing timely access to health and safety risk information, and by increasing the suite of meaningful enforcement tools available to MCCSS when a licensed provider caring for vulnerable children and youth does not comply with licensing requirements.
Analysis of Regulatory Impact:
The impact of the proposed new and amended requirements to the CYFSA and associated regulations on licensed out of home care service providers will be minimal if they are already complying with the licensing requirements set out in the CYFSA, its regulations, MCCSS directives and conditions on the licence and providing high-quality care to children and youth. The increase in cost to businesses is also minimal, assuming licensee compliance with existing requirements. Direct costs are limited to proposed licensing fee changes which would increase licence application and renewal fees, and the administrative costs associated with the time and effort licensees would need to take to familiarize themselves with the legislative and regulatory amendments and changes to the licensing application form.
