Summary of Proposal:
In March 2019, the government passed the Community Safety and Policing Act, 2019 (CSPA), as part of the Comprehensive Ontario Police Services Act, 2019. Once in force, the CSPA will replace the current Police Services Act (PSA). The CSPA is an opportunity to modernize policing and enhance community safety in Ontario.

As part of the work to bring the Act into force, the Ministry of the Solicitor General (SOLGEN) is working on regulations on a number of matters.

As permitted by subsection 262 (6) of the CSPA, the Solicitor General has decided that section 262 of the CSPA, which requires posting proposed descriptions of regulations to be made by the Lieutenant Governor in Council (LGIC) under the CSPA, should not apply in respect of regulations made under paragraph 71 of subsection 261 (1), which are LGIC regulations governing transitional matters related to the CSPA coming into force. The reason for this decision is that the work with impacted stakeholders on the transition from the PSA to the CSPA is ongoing and is anticipated to continue until close to when the CSPA comes into force.

An example of an area in which transitional matters are being identified include the transfer of records between the Ontario Civilian Police Commission, the Office of the Independent Police Review Director, and the Inspector General of Policing relating to investigations within each of their mandates.
Analysis of Regulatory Impact:
SOLGEN may be consulting with stakeholders to identify potential costs associated with the given regulation coming into force.
