Summary of Decision:
Bill 139, the Less Red Tape, More Common Sense Act, 2023 received Royal Assent on December 4, 2023.

Schedule 16 of Bill 139 amended the Retirement Homes Act, 2010 (RHA) by repealing section 122 of the RHA. This amendment removed the requirement for the Minister for Seniors and Accessibility to publish a notice of proposed initial regulations under the RHA for public consultation on the website of the Ministry for Seniors and Accessibility, as the requirement was duplicative of government-wide requirements for consultation and publishing on the provincial Regulatory Registry.

With this amendment, proposed initial regulations under the RHA will only be posted on the provincial Regulatory Registry for consultation, rather than on both the provincial Regulatory Registry and the website of the Ministry for Seniors and Accessibility.

The amendment came into force on Royal Assent, on December 4, 2023.
Analysis of Regulatory Impact:
The Ministry completed a regulatory impact analysis of the legislative change, which was informed by feedback through stakeholder engagement, including posting on the regulatory registry for public comment.

Benefits of the RHA amendment include:
• Responding to requests of the retirement home community to provide faster, more relevant information.
• Supporting a one-window approach for retirement home residents and their families/caregivers, operators and staff, and other stakeholders to provide input on proposed regulations under the RHA.
• Supporting the government's goal of making it easier to work with government, without impacting resident safety.

The amendment is not anticipated to result in any regulatory burden or new direct compliance costs for regulated entities.

Summary of Proposal:
The Less Red Tape, More Common Sense Act, 2023 includes a proposal to amend the Retirement Homes Act, 2010 (RHA) by repealing section 122, which would remove the requirement for the Minister for Seniors and Accessibility to publish a notice of proposed initial regulations under the RHA for public consultation on the website of the Ministry for Seniors and Accessibility.

The policy intent of this proposed amendment is to reduce duplicative processes for posting and consulting on proposed initial regulations under the RHA, given the government-wide approach to posting and consulting on proposed regulations through the provincial Regulatory Registry.

If the proposed amendment is passed, the Minister for Seniors and Accessibility would no longer be required to post a notice of proposed initial regulations under the RHA on the ministry website for public comment. Summaries of proposed initial regulations under the RHA would continue to be posted on the Regulatory Registry for at least 45 calendar days for public comment.
