Summary of Decision:
Bill 139, Less Red Tape, More Common Sense Act, 2023, received Royal Assent on December 4, 2023. The proposed legislative amendments that revoked sections 5 and 7 of the Restoring Ontario's Competitiveness Act, 2019 (ROCA) which in effect removed the un-proclaimed and obsolete sections 2, 3 and 21 of the Farm Registration and Farm Organizations Funding Act (FRFOFA) were approved.
Analysis of Regulatory Impact:
There are no expected costs associated with the proposed amendments to the ROCA as the rules remain unchanged and the program requirements are not changed in any way. The amendment would simply remove the now obsolete sections from the FRFOFA. This means that there would be no new costs, compliance costs or savings for the stakeholders, the program administrator (AgriCorp) or the government.
By revoking sections 5 and 7 of the ROCA, which are un-proclaimed sections, the Government is making the FRFOFA easier to understand without altering the policy intent.

Summary of Proposal:
There are currently two versions of sections 2, 3 and 21 in the FRFOFA. The first version was made through the ROCA but it was later replaced by newer sections through the Better for People, Smarter for Business Act, 2019. This later version was proclaimed and came into effect while the initial version made through ROCA was not proclaimed. The un-proclaimed sections still appear in E-Laws but are highlighted in grey.
If approved, the proposed amendments to the ROCA would minimize potential confusion and improve clarity for anyone referring to the FRFOFA. This is, in turn, expected to make the FRFOFA easier to understand and more accessible.
