Summary of Proposal:
The Ontario Energy Board recovers the majority of its regulatory expenses and expenditures by levying cost assessments on certain prescribed classes that it regulates. Currently under O. Reg. 16/08, electricity retailers and natural gas marketers are not prescribed; the costs associated with regulating the electricity retailer and natural gas marketer sectors are recovered from electricity and gas distributors. The introduction of the Energy Consumer Protection Act, 2010 and its regulations will strengthen the Ontario Energy Board’s oversight over the electricity retailer and natural gas marketer sectors. This will likely increase the costs incurred by the Ontario Energy Board of regulating electricity retailers and natural gas marketers.

The Ministry of Energy is proposing to add to the classes of consumers the OEB can assess. The new classes would consist of electricity retailers and natural gas marketers who are licensed to contract with low-volume consumers. This would allow the OEB to make such electricity retailers and natural gas marketers responsible for the costs the OEB incurs as a result of its oversight of the electricity retailer and gas marketer industries.
