Summary of Proposal:
This regulation, O. Reg. 12/24, amends court rules and forms prescribed by the Rules of Civil Procedure (RCP) for civil court proceedings. It eliminates the requirement to file a Form 14F (Information for Court Use) where the Civil Submissions Online portal is used and makes other administrative corrections and changes to the rules and forms.
The regulation amends 7 rules, a tariff and 26 forms.
Rule 4.05.1(2) is amended to remove an outdated reference to a consent to file documents in French under s. 126 of the Courts of Justice Act.
Rules 14.03(4.1) and 14.05(1.1) are amended to:
- eliminate the requirement to file a Form 14F (Information for Court Use) where the Civil Submissions Online portal is used to file an originating process, and maintain the existing exemption when using Civil Claims Online. Rule 4.05.1(4)(a) is revoked as consequential amendment.
Rules 27.03 and 29.05 are amended to:
- correct references to statements of defence in the main action to achieve consistency in the English and French versions of the rules.
Rules 61.03, 61.10, 62.01, 63.03, and 77.07 are amended to:
- correct references to the term "signed"/"signing" orders with "issued"/"issuing" orders.
Tariff A is amended to:
- correct outdated references (replacing O. Reg. 291/99 by O. Reg. 43/05, and revoking paragraph 27 in the list of disbursements to remove the reference to the cost of the investigation and report of the Official Guardian).
Form 14F is amended to:
- remove the certification statement and requirement for a signature and add a field for the filer's name.
Forms 34E, 43A, 53D, 56A, 59A, 59B, 59C, 64E, 64L, 65A, 66A, 72C, 74I, 74.50, 74.51, 75.8 are amended to:
- insert a "date of issuance" field in various order and judgment forms.
Forms 37B, 38B, 55A, 59D, 63B, 73A, 75.7, 75.1B, 76B are amended to:
- make various housekeeping changes and administrative corrections.
