Summary of Decision:
O. Reg 331/24 and O. Reg. 332/24 amend O. Reg. 353/02 and O. Reg. 354/02 under the Planning Act to empower the Municipality of Magnetawan in relation to two areas of land use planning authority: subdivisions and consents.
The effect of the decision is to give the Council of the Municipality of Magnetawan the power to approve plans of subdivision/ condominium and give consents. The result will be a streamlined, local decision-making process for development applications in the Municipality of Magnetawan.
The regulations are in effect on September 1, 2024.

Analysis of Regulatory Impact:
The result of the proposed amending orders will be the empowerment of the Municipality of Magnetawan council to make decisions on land division within the municipality.
There are administrative costs to process subdivision and consent applications, and to support decision-making by the approval authority. Presently such costs are borne by the Central Almaguin Planning Board and are recovered through application fees established in accordance with section 69 of the Planning Act. If the proposed amending orders are made, applications concerning lands in the Municipality of Magnetawan would no longer be made to the Central Almaguin Planning Board but instead be made to the Municipality of Magnetawan. As such, there is no anticipated net change in administrative costs for regulated entities.

Summary of Proposal:
The Ministry of Municipal Affairs and Housing (MMAH) is proposing to amend regulations under the Planning Act to empower the Municipality of Magnetawan in relation to two areas of land-use planning authority:
1) Approval Authority - Plans of Subdivision
The Minister of Municipal Affairs and Housing is proposing to amend Ontario Regulation 353/02 (Approval Authority - Plans of Subdivision) under the Planning Act in order to make the Municipality of Magnetawan the approval authority under sections 51 and 51.1 of the
Act. This would have the effect of giving the council of the Municipality of Magnetawan the power to approve subdivision and condominium
applications within their municipality.
It is proposed that the regulation would provide approval authority for plans of subdivision/ condominium for the Municipality of Magnetawan made on or after July 1, 2024.
2) Consent Granting Authority
The Minister of Municipal Affairs and Housing is proposing to amend Ontario Regulation 354/02 (Consent Granting Authority) under the Planning Act in order to delegate approval authority to the Municipality of Magnetawan under section 53 of the Act. This amendment would authorize the council of the Municipality of Magnetawan to give consents within their municipality. Pursuant to subsection 57(1) of the Act, the authorization would also permit council to issue validation certificates.
It is proposed that the regulation would delegate approval authority for the above-mentioned types of applications for the Municipality of Magnetawan on or after July 1, 2024.
