Summary of Proposal:
College Introduction

Under the Regulated Health Professions Act, 1991 (RHPA) and the Nursing Act, 1991, the College of Nurses of Ontario (CNO) is responsible for regulating the profession of nursing in Ontario.

Under these Acts, the CNO may make regulations on a variety of subject matter, including registration, subject to the prior review by the Minister of Health and Long-Term Care and the approval of the Lieutenant Governor in Council.

In accordance with this authority, the CNO has made changes to registration requirements concerning applicants and members of the CNO, which are set out in the General regulation under the Nursing Act, 1991.

Summary of Proposal

The CNO has made amendments to O. Reg 275/94 under the Nursing Act, 1991 to introduce new labour mobility provisions that would bring registration requirements into compliance with the labour mobility provisions of the Health Professions Procedural Code, which is Schedule 2 of the RHPA, as amended by the Ontario Labour Mobility Act, 2009.

These amendments were filed on June 22, 2012 and immediately came into force. The amendments were filed as O. Reg. 174/12. The amendments were published on e-laws on June 26th, 2012 and in the Ontario Gazette on July 7th, 2012.

The CNO also made amendments to achieve the following objectives:

a) create a new Emergency Assignment Class of registration;
b) eliminate the Retired Class of registration and create a new Non-Practising Class of registration;
c) clarify evidence of practice requirements for applicants;
d) introduce a jurisprudence examination requirement for applicants;
e) introduce a 2-year currency timeframe for language proficiency requirements for applicants;
f) introduce evidence of current practice requirements for members;
g) update registration requirements related to suitability and fitness to practice, as well as ongoing terms, conditions and limitations for all classes of certificates of registration;
h) require all members to hold professional liability protection in accordance with the CNO's by-laws;
i) clarify the terms, conditions and limitations on the Special Assignment Class certificate of registration;
j) clarify eligibility criteria for the entry-to-practice examination ;
k) introduce new provisions related to administrative suspensions, revocation and reinstatement of members; and
l) make miscellaneous and housekeeping amendments.

The above mentioned amendments were filed on June 22, 2012 as O. Reg 175/12 and come into force on January 1, 2013. They were published on e-laws on June 26, 2012 and in the Ontario Gazette on July 7, 2012.
