Amending Ontario Regulation 682/21 to Prescribe Hazel McCallion Light Rail Transit Line Extensions under the Building Transit Faster Act, 2020

Summary of Proposal:
MTO is proposing to amend Ontario Regulation (O.Reg 682/21) to add the Hazel McCallion Light Rail Transit Line extensions connecting to the downtown area of the City of Mississauga in the area known as Square One and connecting to the downtown area of the City of Brampton along Hurontario Street and Main Street commencing at the intersection of Steeles Avenue and Hurontario Street , as a priority transit project under the Building Transit Faster Act, 2020 (BTFA). It is expected that prescribing the extensions would help the government deliver these transit extensions in a more efficient and streamlined manner.

If the amendment to this regulation is made, a number of measures under the BTFA would become available for Metrolinx to use to streamline the process for building the extensions.

The measures introduced by the BTFA provide:
•The ability to enter lands for due diligence work (e.g. soil testing), removal of obstructions and encroachments (e.g., trees), addressing imminent danger, and for the purpose of ensuring that a permit or stop-work order is being complied with;
•A framework for enhanced coordination of utility relocations to support better management of project schedule and costs;
•A streamlined land assembly process;
•An approach to municipal permits, and backstop authority to compel access to municipal rights-of-way and services (water, sewer); and
•Requirements for owners of adjacent land and infrastructure to obtain a corridor development permit for construction and development activities that may interfere with transit construction.

In March 2021, a Minister's regulation (O.Reg 181/21) came into force delegating certain provisions of the BTFA to Metrolinx. Once prescribed as a priority transit project under the BTFA, two measures of utility coordination and municipal right of way would be immediately available to Metrolinx. The other three measures: corridor development permits, entering lands, and land assembly, would be only available to Metrolinx upon designation of transit corridor lands.
Analysis of Regulatory Impact:
The proposed regulatory amendment will only prescribe the Hazel McCallion Light Rail Transit Line extensions connecting to the downtown area of the City of Mississauga in the area known as Square One and connecting to the downtown area of the City of Brampton along Hurontario Street and Main Street commencing at the intersection of Steeles Avenue and Hurontario Street, as a priority transit project under the Act. If approved, the BTFA measures will enable Metrolinx to expedite delivery of the HML extensions. Accelerating transit delivery is part of the government's plan to build transit faster so people can get where they want to go, when they want to get there, while reducing congestion and driving economic growth and job creation.

This proposed regulatory amendment does not negatively impact small businesses or regulated entities.
