Summary of Decision:
Amendments to the Construction Lien Act include the removal of certain requirements, which will facilitate the vacating of construction liens and certificates of action from a property record while protecting the rights of sheltered lien claimants. The concept of ?sheltering? as provided for under the Construction Lien Act is a complex issue for both construction law practitioners and Land Registry Office staff when considering whether liens and certificates of action can be deleted from the property title. The changes to the Ontario Regulation 19/99 under the Land Registration Reform Act and the electronic land registration system will assist with and simplify the process for such deletions.

To facilitate the deletion of a certificate of action that may or may not have another lien sheltering under it the following law statement will be added to the Sheltering Statements in the electronic Discharge of Construction Lien document type:

The deletion of Certificate(s) of Action number(s) number is in accordance with the Construction Lien Act.

The amending regulation for the changes to Ontario Regulation 19/99 is a Director of Titles? regulation. The effective date for the amendment of the regulation is July 1, 2011.

To communicate these changes to the land registry office staff and users of the system, a Bulletin will be issued outlining the background, legislation, system changes & Ministry policy and the Electronic Registration Procedures Guide is in the process of being updated.
