Summary of Proposal:
The Civil Rules Committee, with the approval of the Attorney General, amended a regulation of the Courts of Justice Act that deals with the consequences of setting a case down for trial. The amendment to Rule 48.04 clarifies that a party does not need permission from the court to bring a motion to compel the other party to fulfil the obligations set out in 48.04(2)(b).
