Summary of Decision:
The required regulatory amendments correct some errors and inconsistencies between the amended HTA and its regulations created by the Road Safety Act, 2009. These regulatory amendments are as follows:
• Changes to statute subsection and paragraph numbers to reflect HTA amendments;
• Changes in terminology consistent with the amended sections of the Act (e.g. Notice of Impoundment rather than Order to Impound); and
• Removal of regulatory pieces related to serving notices as amendments to the Act remove service requirements.

Summary of Proposal:
MTO proposed amendments to regulations related to the following road safety programs:
• Administrative Driver’s Licence Suspensions under Section 48.3 of the Highway Traffic Act (HTA) for drivers with a blood alcohol concentration over the legal limit (80 mg), or who refuse to comply with a demand made by a police officer pursuant to the Criminal Code of Canada
• Vehicle impoundments under Section 55.1 of the HTA for drivers suspended for Criminal Code of Canada conviction (e.g. drinking and driving, dangerous driving) who operate a motor vehicle on a highway
• Commercial motor vehicle impoundments under Section 82.1 of the HTA for vehicles operated on a highway despite critical safety defects (e.g. insufficient brakes)
