Summary of Decision:
Implementation of the EP regulations will continue to take place in a phased-in approach. However, Phase I will take effect on August 1, 2007 and Phase II will come into force on December 1, 2008.

Implementation of the Spill Prevention and Contingency Plans regulation will take effect on September 1, 2008

Summary of Proposal:
The Ministry is proposing draft regulations and guidance documents that would support the implementation of Environmental Penalties (EPs). The Environmental Enforcement Statute Law Amendment Act, 2005, (EESLAA) received Royal Assent on June 13, 2005. The EESLAA amended the Environmental Protection Act (EPA) and the Ontario Water Resources Act (OWRA) to allow a Ministry Director to impose financial penalties in response to spills, unlawful discharges and other violations. Although the EESLAA has received Royal Assent, the provisions that relate to EPs and other unproclaimed provisions of the EESLAA will be proclaimed in to law following the development and approval of the final regulations.
