The regulation amendment to Regulation 543 - X-Ray Safety Code has been filed as O. Reg. 173/11 under the Healing Arts Radiation Protection Act. The regulation amendment will be published on e-laws May 25, 2011 and in the Ontario Gazette on June 4, 2011.

Regulation 543 - X-Ray Safety Code made under the Healing Arts Radiation Protection Act (HARP Act) was amended to define Computed Tomography (CT) scanners, including dental CT scanners, as a class of X-ray machine; limit the types of health professionals who are authorized to prescribe CT scans and operate CT scanners; and specify the health professionals who are authorized to prescribe dental CT scans and operate dental scanners in a dental facility. Key highlights of the regulation include:

-Defining CT scanners and dental CT scanners.
-Limiting the types of health professionals who may prescribe (order) CT scans: Physicians and Oral and Maxillofacial Surgeons.
-Limiting the types of health professionals who may operate CT scanners: Physicians and Medical Radiation Technologists.
-Specifying the types of health professionals who may prescribe (order) dental CT scans in a dental facility: Oral and Maxillofacial Radiologists and Dentists who meet the qualifications established by the Royal College of Dental Surgeons of Ontario's Standard of Practice - Dental CT Scanners.
-Specifying the types of health professionals who may operate dental CT scanners in a dental facility: Oral and Maxillofacial Radiologists, Dentists who meet the qualifications established by the Royal College of Dental Surgeons of Ontario's Standard of Practice - Dental CT Scanners and Medical Radiation Technologists under the supervision of an Oral and Maxillofacial Radiologist or a Dentist(s) who meet(s) the qualifications established by the Royal College of Dental Surgeons of Ontario's Standard of Practice - Dental CT Scanners.

Summary of Proposal:
As part of the Ministry of Health and Long-Term Care’s commitment to ensure the safe and appropriate use of Computed Tomography (CT), a proposed regulatory amendment under the Healing Arts Radiation Protection Act (HARP Act) seeks to improve patient safety by establishing CT, including Dental CT, as a class of X-ray machine with unique safety considerations, and setting out who can order and operate CT and Dental CT scans and scanners to ensure that the appropriate health care professionals are using these devices in the province of Ontario.

The aims of the CT safety initiative project are consistent with the Excellent Care for All Strategy, which ensures that the health care system is focused on the quality of care and the best use of resources. They are also consistent with the province’s health human resources strategy, HealthForceOntario, which, among other things, promotes the objective of quality health care services delivered by qualified health practitioners.

Through the proposed regulatory amendment under the HARP Act, the Ministry of Health and Long-Term Care seeks to:
• Define CT scanners, including Dental CT scanners, as a class of X-Ray machine;
• Set out the health professions that are authorized to order CT scans: Physicians, Nurse Practitioners, and Oral and Maxillofacial Surgeons;
• Set out the health professions that are authorized to operate CT scanners: Physicians and Medical Radiation Technologists; and
• Set out the health professions that are authorized to order and operate Dental CT scans and scanners in a dental facility: Oral and Maxillofacial Radiologists and Dentists who meet the qualifications established by the Royal College of Dental Surgeons of Ontario.
