Amendments to Regulation 753 and to Regulation 761 were filed with the Registrar of Regulations on January 24, 2011. The amendments have revoked provisions of the regulations that pertain to processing, composition and labeling standards for dairy/edible oil spreads, and lift a prohibition on the manufacture, sale and distribution of filled milk products in Ontario.

Summary of Proposal:
Amendments to Regulation 753 and to Regulation 761 have removed processing, composition and labeling standards for dairy/edible oil spreads, and lift a prohibition on the manufacture, sale and distribution of filled milk products in Ontario.

Dairy/edible oil spreads combine dairy ingredients and edible oils to resemble, or substitute for, butter, for example spreadable butters. Filled milk products are beverages with at least 51 per cent, by volume, of milk, to which edible oil has been added (other than edible oil for flavouring and omega 3 oils). Filled milk products include milks and creams from which the milk-fat has been removed and replaced with plant-based fats or oils.

Amendments to both Regulation 761 and to Regulation 753 ensured that Ontario is in compliance with its obligations under the Agreement on Internal Trade.
