Summary of Proposal:
Pursuant to subsection 93(1) of the Ontario College of Trades and Apprenticeship Act, 2009, the Ontario College of Trades Board of Governors is required, on or before the implementation date, to cause the initial review referred to in subsection 60(3) of the Act to be begun with respect to every trade that has been prescribed by a Minister?s regulation as being subject to a journeyperson to apprentice ratio and to make a Board regulation described in subsection 61(3) with respect to the status of a trade as compulsory or voluntary. The implementation date is July 5, 2011 or such other date as may be prescribed by a regulation.
In Fall 2010, the Board of Governors undertook public consultations across Ontario and invited stakeholders to provide written submissions on the proposed criteria and process for ratios and compulsory certification review with the intent of meeting the above-mentioned obligations with respect to ratio and compulsory certification review by July 5, 2011.
Further work is required in considering the criteria and process to be included in the regulations for ratio and compulsory certification reviews. Further time is also needed to recruit for the roster of adjudicators from which the review panels will be appointed. Therefore, it is proposed that the implementation date of July 5, 2011 be changed to January 1, 2012 through a Lieutenant Governor in Council regulation under section 93(3) of the Act.
