Summary of Decision:
On June 28, 2011, a new regulation made under the Alcohol and Gaming Regulation and Public Protection Act, 1996 was filed.

The regulation sets out the responsibilities of tax collectors relating to the keeping of records associated with the exemption from tax of up to 10,000 litres of beer, wine or wine coolers distributed by manufacturers without charge for purposes of promotional distribution.

Summary of Proposal:
A regulation is proposed to amend O.Reg. 257/10 (Beer and Wine Tax) under the Alcohol and Gaming Regulation and Public Protection Act, 1996. The proposed regulation would be consequential to changes included in Schedule 2 of Bill 173, the Better Tomorrow for Ontario Act (Budget Measures), 2011. The Minister of Finance would make the amendment to O.Reg. 257/10 if Schedule 2 of Bill 173 is enacted by the Legislature.

The regulation would set out the responsibilities of tax collectors relating to the keeping of records associated with the exemption from tax, proposed in Bill 173, of up to 10,000 litres of beer, wine or wine coolers distributed by manufacturers without charge for the purposes of promotional distribution. The regulation would also remove the definitions of "sales year" and "production year", as these definitions would be moved to the Act under Bill 173. (the definition of "sales year" for the transition year which began on July 1, 2010 and will end on February 28, 2011 is already included in O.Reg. 257/10).
