Summary of Proposal:
Schedule 34 of the Better Tomorrow for Ontario Act (Budget Measures), 2011, (BTOA) included amendments to the Ontario Lottery and Gaming Corporation Act, 1999 (OLGCA) to enhance transparency and clarity and to align with a comprehensive risk-based regulatory framework under the Gaming Control Act, 1992 (GCA).

To complement the OLGCA statutory changes, amendments to the OLGCA regulations were required. These include:

- Amendments to Regulations 198/00 and 199/00 (via Regulations 85/12 and 86/12 respectively) and revocation of Regulation 15/02 and 200/00 (via Regulations 82/12 and 83/12 respectively) are consequential to changes in the OLGCA made under the BTOA.

- Section 12 of the OLGCA requires the Ontario Lottery and Gaming Corporation (OLG) to follow prescribed steps before establishing a gaming site, as amended by the BTOA. The prescribed conditions are set out in Regulation 81/12, which contains new defined terms and language that reflects changes to the OLGCA made under the BTOA. The process includes government oversight, a business case completed by OLG and the need for local community consultation and support.

- Regulation 84/12 under the OLGCA, now prescribes the criteria that defines a major capital expenditure by OLG as required under section 13(2) of the Act, as amended by the BTOA.

Changes to definitions in the OLGCA made under the BTOA and the introduction of Regulation 81/12 requires consequential amendments to Regulation 425/00 under the Municipal Elections Act, 1996.

These amendments are complementary to regulatory changes made concurrently under the GCA.
