Summary of Decision:
A decision was made to proceed with the proposal as described, subject to changes made below as a result of public consultation.
The proposal was implemented by O. Reg. 310/12. This regulation amendment was filed by the Registrar of Regulations on October 4, 2012 and was published in the Ontario Gazette on October 20, 2012.

Effective November 1, 2012, MNDM has amended the Claim Staking and Recording Regulation to require that claim stakers provide GPS data for claim boundaries on the application to record a mining claim. This would be a step towards clarifying claim locations in advance of the planned move to fully electronic, on-line map staking. This requirement would only apply to ground staked mining claims on lands that are un-surveyed (not surveyed into lots and concessions).

Comments were consistent with what was decided with overall acceptance of the approach. Clarification was requested on how the Ministry will administer fractions and overlaps and that the standards need to be reasonable and consistent with industry standards. In response, MNDM has developed a balanced set of standards which meet the accuracy the Ministry requires but can still be easily met by any claim staker. These standards are documented and will be available on the Ministry website.

Proposals for most of the Mining Act's first phase of new regulatory provisions were posted on the Environmental Registry (ER) or Regulatory Registry in November, 2010, and were implemented in Spring 2011.

As part of the Phase II implementing regulations under the Mining Act, MNDM is proposing to amend the Claim Staking and Recording Regulation to require that claim stakers provide GPS data for claim boundaries on the application to record a mining claim, as a step towards clarifying claim locations in advance of the planned move to fully electronic, on-line map staking. This requirement would only apply to ground staked mining claims on lands that are unsurveyed (not surveyed into lots and concessions).
