Summary of Proposal:
Digital recording technology is currently being implemented in Ontario's courts. Regulatory amendments under the Administration of Justice Act will enable courts administration to charge a fee to a party requesting a CD copy of a digital court recording. Judicial authorization is also required before a copy of a court recording can be released. The estimated cost of providing such copies is $21.80 per case, for a day of proceeding (regardless of the length of the proceeding) or for the first day of an order for a multiple day proceeding, and the suggested fee is $21. If multiple days of the same case are ordered, the estimated cost for each additional day is $10.12 and the suggested fee is $10 for each additional day. The order for multiple day requests must be received at the same time and all matters must have been heard so that the request can be processed as a single transaction. The regulatory amendments will allow the Ministry and municipalities to recover costs for providing digital copies in all levels of Ontario courts.
