Ontario Regulation 391/11- Amending O. Reg. 279/02 (Consents under the Act) and Ontario Regulation 392/11 - Revoking Various Regulations (O. Reg. 280/02 and O. Reg. 281/02), both made under the Postsecondary Education Choice and Excellence Act, 2000, were filed August 19, 2011. The new Regulations are published on Ontario Government E-laws website and will come into force on January 1, 2012.

Summary of Proposal:
The Ministry of Training, Colleges and Universities is proposing to recommend amendments to one regulation and revocation of two other regulations, all made under the Postsecondary Education Choice and Excellence Act, 2000, to improve administrative efficiency and to implement June 2010 amendments to the Act.
Two existing regulations under the Act ( O. Reg. 280/02 - Claims Against Security, and O. Reg. 282/02 - Decisions, Orders and Appeals) would be consolidated into the existing regulation on Consents Under the Act (O. Reg. 279/02), which would also be amended to make housekeeping and consequential technical changes for better clarity; to prescribe criteria governing when the Minister of Training, Colleges and Universities may reject a consent application without a referral for a quality assurance review to improve efficiency and reduce unnecessary costs to an applicant; to establish an administrative monetary penalties regime for contraventions of the Act for effective enforcement; and to establish criteria governing when the Minister may recognize quality assurance (QA) or accrediting bodies other than the Postsecondary Education Quality Assurance Board, as currently required under the Act, for purposes of referring consent applications or for deeming prior review of such bodies to be a review under the Act.
