Amendments to Ontario Regulation 246/22 under the Fixing Long-Term Care Act, 2021 to align with the Health and Supportive Care Providers Oversight Authority

The Ministry of Long-Term Care is continuing to improve the long-term care system so every resident experiences an optimal quality of life, supported by safe, quality care. This work is built on four pillars: staffing and care, quality, and enforcement, building modern, safe, and comfortable homes, and supporting the broader continuum of services for seniors. Based on these priorities, the Ministry is seeking to align the qualifications for personal support workers in Ontario Regulation 246/22 with the proposed registration pathways for the Health and Supportive Care Providers Oversight Authority to ensure consistency and clarity for residents, employers, families, and caregivers.

Regulations Pertaining to the Health and Supportive Care Providers Oversight Authority (the Authority)

Regulations under the Health and Supportive Care Providers Oversight Authority Act, 2021 (HSCPOA Act). These objects include (but not limited) to: 1. administer the HSCPOA Act and the regulations, including overseeing their enforcement; 2. establish educational and skills-based qualifications for each class of registrants; 3. establish visual marks or identifiers for use by registrants that can identify registrants to members of the public; 4. promote the provision of safe, competent, ethical and high-quality health and supportive care services by registrants; 5. establish codes of ethics in relation to services they provide to members of the public.

Ontario College of Pharmacists: General Regulation 202/94 made under the Pharmacy Act, 1991, and consequential amendments to other regulations and statutes.

The Ontario College of Pharmacists (College) is proposing amendments to O. Reg. 202/94 made under the Pharmacy Act, 1991, to update the requirements for registration with the College. The College is also updating provisions pertaining to its quality assurance program. The Ministry of Health is also proposing consequential amendments to regulations made under various statutes to ensure consistency with the newly created registration classes proposed by the College. These include O. Reg. 107/96 (Controlled Acts) made under the Regulated Health Professions Act, 1991, and O. Reg. 45/22: General made under the Laboratory and Specimen Collection Centre Licensing Act, 1990.

Proposed Amendments to O.Reg. 212/17 under the Investment Management Corporation of Ontario Act, 2015 ("IMCO Act")

The proposed regulatory amendment would prescribe Tarion Warranty Corporation as an eligible member of IMCO. This would allow Tarion Warranty Corporation to hire IMCO to manage the Tarion Guarantee Fund, if it so desires.

Proposing Administrative Monetary Penalties under the Fire Protection and Prevention Act, 1997

The Ministry of the Solicitor General is seeking input on proposed amendments to the Fire Protection and Prevention Act, 1997 (FPPA) that would enable an administrative monetary penalty (AMP) framework for contraventions of the FPPA and its regulations. This would allow the ministry to develop a new mechanism to improve and augment enforcement and compliance with the FPPA and its regulations, such as the Ontario Fire Code. AMPs provide an enforcement option imposed through an administrative process and do not result in a criminal record or imprisonment. AMPs can be imposed instead of, or in addition to, other enforcement measures.
