The Ministry of Energy is proposing to amend Ontario Regulation 16/08 to allow the Ontario Energy Board to conduct cost assessments on electricity retailers and natural gas marketers that service low-volume customers.

Confirmation of claim staking on lands with private surface rights owner will be required under S. 46.1 of the Mining Act when that section is proclaimed in force. The claim-staker will be required to notify the surface rights owner(s) if any within 60 days of submitting an application to record a claim. A new provision would determine the manner that the notification of claim staking is given to the surface rights owner.

MNDMF is proposing to introduce a paper-based process for map staking for Southern Ontario and to consolidate the two claim staking regulations (Ontario Regulation 7/96 and Ontario Regulation 365/98) under a single Claim Staking and Recording regulation.

The Ministry is proposing (A) additional criteria for assessing requests for the withdrawal of Crown mining rights in Northern Ontario where there is a surface rights owner and (B) the manner in which a surface rights owner could apply to have the land reopened for claim staking and exploration.

The Mining Act provides a new exemption from the Mining Land Tax under S. 189 of the Mining Act. This provision will allow the Minister to exempt lands that were originally granted by Crown patent for mining purposes from being subject to the Mining Land Tax provided that the lands are not used, and are not intended to be used for mining purposes. The proposal: (A) adds to the criteria used for assessing exemption requests and (B) proposes a process for rescinding them in future if required.

The amended Mining Act (S.35) has provisions that allow for the withdrawal of certain lands, including sites of Aboriginal cultural significance from claim staking on Crown land. The Act also includes a provision (under S.51) that could protect sites of Aboriginal cultural significance by a surface rights restriction on portion of a mining claim. MNDMF is proposing to develop criteria for sites of Aboriginal cultural significance for the purposes of withdrawals or surface rights restrictions.

MTO is proposing to amend Ontario Regulation 629 to modernize the technical requirements for highway vehicles (e.g. buses, transit buses, motor coaches, taxis, physically-disabled-passenger vehicles, and school buses) as part of the Ministry of Community and Social Services’ (MCSS) proposed standards under the Accessibility for Ontarians with Disabilities Act (AODA), 2005. MCSS is proposing that the Transportation Standard be part of an Integrated Accessibility Regulation (IAR).

The Ministry of the Environment, through Schedule 7 (Modernization of Approvals) of the proposed Open for Business Act, 2010, is proposing a system to modernize Ontario’s environmental approvals process.

Pursuant to the Energy Consumer Protection Act, 2010, the Ministry of Energy and Infrastructure is recommending new draft regulations. These draft regulations would further protect Ontario consumers who choose to purchase their energy from electricity and natural gas retailers/marketers, and enable individual suite metering in multi-unit buildings to promote energy conservation.

On December 4, 2009, a new regulation made under the Toxics Reduction Act, 2009 was filed with the Registrar of Regulations as Ontario Regulation 455/09. The regulation and Act came into force on January 1, 2010. The Ministry is proposing to amend O. Reg. 455/09 to address the requirements related to “toxic substance reduction planners” . The Ministry is also seeking comments on options for enhanced planning.

The goal of the Clean Water Act, 2006 is to protect existing and future sources of drinking water, as part of an overall commitment to human health and the environment. A key focus of the legislation is the preparation of locally developed, science-based assessment reports and source protection plans. As required by the Act, regulations must be developed to enable local source protection committees to complete their source protection plans.
