Amendments to Ontario Regulation 79/10 under the Long-Term Care Homes Act, 2007

The amendments allow for the designation of reunification priority access beds (RPABs) for spouses / partners in crisis, require the disclosure of personal information in certain situations, permit the Director under the LTCHA to designate specialized units on his or her own initiative, and permit the Ministry to serve a document by use of a commercial courier.

O. Reg. 538/17 was filed on December 18, 2017, amending O. Reg. 331/11 to extend the revocation date of section 6.2 of O. Reg. 329/04 from January 1, 2018 to January 1, 2020.

Exemptions to the "Electronic Transmission of Documents" in the Reducing Regulatory Costs for Business Act, 2017

The regulation provides exemptions to this provision whereby a ministry is not required to receive documents electronically from a business in certain circumstances.

A special rule for the auto sector regarding Personal Emergency Leave (PEL) days in certain circumstances in regulation "Terms and conditions of employment in defined industries - automobile manufacturing, automobile parts manufacturing, automobile parts warehousing and automobile marshalling", under the Employment Standards Act, 2000.

Auto sector employees will not be entitled to PEL pay if they are entitled under their employment to receive two or more paid days that are in excess of the ESA's vacation or public holiday standards or the paid days are for personal illness or medical appointments. This special rule applies to unionized and non-unionized employees in the sector. The 50 employee threshold has also been removed. Employers are prohibited from requesting a note from a qualified health practitioner as evidence.

OHIP Provisions for Children Receiving Protective Services to align with changes to existing legislation.

The Ministry of Health and Long-Term Care (MOHLTC) is requesting approval to make consequential amendments to provisions respecting Ontario Health Insurance Plan eligibility for children in the care of a children's aid society in Regulation 552 under the Health Insurance Act (HIA) to align with changes to the Child and Family Services Act (CFSA) that will permit child protection services to be extended to 16- and 17-year-olds, which is expected to be proclaimed into force on January 1, 2018.

Proposal to reflect amendments to the Employment Standards Act, 2000 made by the Fair Workplaces, Better Jobs Act, 2017 to exempt construction employees from Personal Emergency Leave (PEL) Pay entitlement under specified circumstances.

The Fair Workplaces, Better Jobs Act, 2017 amends the ESA to provide all employees with ten PEL days per calendar year. If an employee has been employed for at least one week, the first two days would be paid. The proposed regulation would exempt construction employees from the entitlement to paid personal emergency leave if they receive at least 0.8% of their hourly rate or wages as personal emergency pay. Their entitlement to 10 PEL days per calendar year would not be affected.

Proposed consequential amendments to O. Reg 285/01 and O. Reg. 476/06 under the Employment Standards Act, 2000 as a result of the Fair Workplaces, Better Jobs Act. These amendments would remove provisions that would be addressed in the ESA, specifically: those addressing the minimum wage rate that applies to a student who is a homeworker, determining minimum wage compliance when changes to the minimum wage take place during a pay period, and prescribed family members.

Amendment to the Benefit Plans Regulation under the Employment Standards Act, 2000 regarding Pooled Registered Pension Plans

The Ministry of Labour is proposing to amend regulation O. Reg. 286/01 made under the Employment Standards Act, 2000 (ESA) to exempt certain aspects of pooled registered pension plans from the ESA's prohibition on age-based differentiation with respect to pension plans.

Proposed increase to administrative monetary penalties (Notice of Contravention) under Employment Standards Act, 2000 and Employment Protection for Foreign Nationals Act, 2009

The proposal would amend Regulation 289/01 (Enforcement) under the Employment Standards Act, 2000 and Regulation 47/10 (Penalties) under the Employment Protection for Foreign Nationals Act, 2009 by increasing the value of the penalties for contraventions of the Acts.

This includes transitional rules in relation to remedial certification, review of structure of bargaining units, no discharge or discipline without just cause during lawful strike or lock-out periods, fines for offences, and location and method of voting.

Proposed Cigarette Filter Components Regulation

The Ministry of Finance regulates the distribution of tobacco products in Ontario. The Tobacco Tax Act was amended to introduce a new regulatory regime for oversight on the import and possession of cigarette filter components to reduce the supply to the unregulated tobacco market. The Ministry of Finance is developing regulatory and administrative measures to support amendments to the Tobacco Tax Act, which will come into effect January 1, 2018.

The proposal would amend Regulation 909 to make the temporary exemption for certain plans to file a reference valuation permanent.

Proposed Amendment to Ontario Regulation 909 under the Pension Benefits Act - Extending the Temporary Exemption for Certain JSPPs from the Annual Valuation Filing Requirement

The proposal would amend Regulation 909 to extend the temporary exemption from annual filing requirements for an additional two years to December 31, 2019.

New regulation under the proposed Reducing Regulatory Costs for Business Act, 2017

The Ministry of Economic Development and Growth (MEDG) has introduced the proposed Reducing Regulatory Costs for Business Act, 2017, which would implement five new burden reduction initiatives. If the proposed Act passes, MEDG would propose to bring forward a new regulation to support it.

Amendment to R.R.O. 1990, Regulation 418 (Greenhouse Vegetables - Plan) under the Farm Products Marketing Act

The Commission is proposing to make amendments to Regulation 418 (Greenhouse Vegetables - Plan), which would extend consecutive term limits for board members from three consecutive two-year terms to five consecutive two-year terms and to prohibit the appointment of a producer to the greenhouse vegetable board if that producer is not eligible for election.

Homes for Special Care Modernization (OPDP)

The Ministry of Health and Long-Term Care (MOHLTC) is proposing regulatory amendments to Ontario Regulation 201/96 made under the Ontario Drug Benefit Act to support the ministry's Community Homes for Opportunity (CHO) program. The CHO program is part of the ministry's plan to modernize the Homes for Special Care program.

Proposed Regulatory Amendments to Increase the Payment Farm Business Must Make To An Accredited Farm Organization To Obtain A Farm Business Registration Number and Other Housekeeping Amendments

The Ministry of Agriculture, Food and Rural Affairs (OMAFRA) is - at the request from the National Farmers' Union of Ontario (NFU-O), the Christian Farmers' Federation of Ontario (CFFO) and the Ontario Federation of Agriculture (OFA) - proposing to have amendments made to O. Reg. 723/93 to increase the current payment farm businesses must make to an Accredited Farm Organization, as well as other housekeeping updates.

Proposed Enhancements to the Beef Cattle Financial Protection Program to Include Breeder Co-Operatives and Improve Alignment with the Feeder Cattle Loan Guarantee Program

The Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) is proposing amendments to Regulation 560/93 (Fund for Livestock Producers) to designate sales by Feeder and Breeder Co-operatives as sales by individual members for the purposes of the Beef Cattle Financial Protection Program, and to allow Beef Breeder Co-Cooperatives to participate in the Beef Cattle Financial Protection Program.

Proposed amendment to Lakes and Rivers Improvement Act Dam Construction Regulation (Ontario Regulation 454/96) to specify that approval is not required for alterations, improvements and repairs to existing dams in cases where they are governed by an agreement between the Minister and the dam owner.

The Ministry of Natural Resources and Forestry is seeking comments on a proposal to amend Ontario Regulation 454/96 under the Lakes and Rivers Improvement Act to enable 2016 policy for entering into agreements for alterations, improvements and repairs to existing dams. The proposed amendment will allow MNRF to govern alterations, improvements and repairs to existing dams for qualified dam owners through an agreement, and remove the duplicative requirement for LRIA section 16 approvals.

Amendment to Ontario Regulation 316/07 under the Provincial Parks and Conservation Reserves Act, 2006 to add land to Stoco Fen Provincial Park.  (source: Environmental Registry)

Stoco Fen Provincial Park is a 203 ha nature reserve class park that was established in 1985. The park protects most of the open fen component of the provincially significant Stoco Fen wetland and Area of Natural and Scientific Interest. The Ministry of Natural Resources and Forestry (MNRF) is proposing to regulate three parcels of land. Adding these lands to the park will further protect sensitive wetland habitat and headwater areas.
