The Calculation of Fees for Pupils Regulation specifies the tuition fee amounts that may be charged by publicly-funded school boards for the school year. Amendments to the GSN are based on policy and decisions made in the context of the government's overall budgetary decisions.

An amendment to O. Reg 323/07, Royalty on Diamonds, under the Mining Act, R.S.O. 1990, c. M.14, to provide the Minister with the discretion to assess interest or not for late payments

Under O. Reg 323/07, late payments of the diamond royalty are subject to interest payments and penalties. To accommodate hardships related to COVID-19 and to align with the relief period provided under the Mining Tax Act, amendments have been made to subsection 12(3) of O. Reg 323/07 that would allow the Minister the discretion to assess interest or not. This parallels the s. 12(1) discretion for penalties on late payments.

The COVID-19 pandemic caused several timing issues regarding deadlines, including for the renewal of licences for grain and beef cattle dealers, as well as grain elevator operators, issued under the ministry's Financial Protection Programs. Regulatory amendments are being proposed to extend the expiry date for licences issued under the programs by 90 days after the COVID-19 Emergency Order is lifted.

OMAFRA Emergency Livestock Medicines Outlet Licence Extension under Livestock Medicines Act in the Context of COVID-19

For approximately 540 licensed Livestock Medicines Outlets (LMOs) current licences expire on July 31, 2020. To protect animal health and ensure uninterrupted licensing of LMOs while Ontario is dealing with the COVID-19 outbreak, OMAFRA is amending Regulation 730 under the Livestock Medicines Act to extend the validity of the current Class 1 licence until July 31, 2021 at no cost to current licensees.

The Ontario Farm Products Marketing Commission has amended R.R.O. 1990, Regulation 753 (Grades, Standards, Designations, Classes, Packing), under the Milk Act. The amendments, which align with Canada's national dairy strategy, eliminate milk class 6 from the classification table within the regulation, and reclassify products and ingredients formerly under this class. Milk classification is based on end use. The amendments were made to comply with the Canada-United States-Mexico Agreement.

Due to COVID related closure of examination centres for nutrient management certification and licensing, the expiry dates of the 4 certificates and 2 licences issued under O. Reg. 267/03 of the Nutrient Management Act that would have expired between April 14, 2020 and April 29, 2021 are extended. The new expiry date will be April 30, 2021. Applicants that have already passed an examination within the year prior to April 14 may use that passing grade to apply for renewal until April 30, 2021.

On June 1, 2020, the government implemented a flat COVID-19 Recovery Rate of 12.8 ¢/kWh for all Regulated Price Plan (RPP) Time-of-Use (TOU) electricity customers. The government intends that RPP TOU customers will be charged this flat rate for all periods of the day, seven days a week, until October 31, 2020.

New regulation made under the Connecting Care Act, 2019 (CCA) - Prescribed Organization

The regulation allows Ontario Telemedicine Network (OTN) to be prescribed for the purposes of subsection 40 (1) of the Connecting Care Act, 2019. Prescribing an organization in this fashion authorizes the detailed information gathering that is required to plan appropriately for potential transfers into Ontario Health (OH). The regulation was filed with the Registrar of Regulations on November 28, 2019 and will come into effect on January 1, 2020.

Proposed changes to the AgriInsurance Program - Contract of Insurance and Appeals

Suspension of Time-Of-Use (TOU) Electricity Rates during COVID-19 Outbreak

On March 24, 2020, the government set electricity prices for Time-Of-Use (TOU) customers at the off-peak TOU electricity rate of 10.1 cents per kilowatt hour for all periods of the day, seven days a week, until May 7, 2020. On May 6, 2020, the government announced an extension to the TOU off-peak rate. The intention is to extend the TOU off-peak rate until May 31, 2020.

COVID-19 Pandemic Response: Relief from Additional Co-Payment

To help alleviate the unintended cost impact to ODB program recipients due to measures taken by government in response to COVID-19, the Ministry of Health is proposing to amend O. Reg. 201/96 under the Ontario Drug Benefit Act to ensure recipients are not paying additional co-payments as a result of government's 30-day supply limit recommendation. The cost of the additional co-payments would be shared between the government and dispensers through proposed amendments to dispensing fee rules.

COVID-19 Pandemic Response: Relief from Trillium Drug Program Deductible

To help alleviate the cost impact to Trillium Drug Program (TDP) households as a result of loss of income, the Ministry of Health is proposing to extend the in-year deductible reassessment to include significant income changes that occur in the latter half of the TDP benefit year. This would allow households to use their 2020 income information for the determination of their deductible in the current 2019/20 benefit year (from May 1st until July 31st, 2020).

The Ministry of Health and Long-Term Care is proposing an amendment to Regulation 552 of the Health Insurance Act to end the Out-of-Country Travellers Program. In addition, amendments are being proposed to remove all references to osteopathy that are found under the regulation because osteopathy has not been recognized as a regulated health profession since 2004.

Exceptions to Disclosure of Personal Information for Planning and Managing Services under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Part X establishes authorities for the Minister to collect, use and disclose personal information (PI) for specific purposes including system planning, management and research. Part X allows sharing of PI for these purposes with prescribed entities (PEs) and non-prescribed entities/persons (Non-PEs) (i.e. First Nations, Inuit or Métis entities/persons) in regulation. The proposed regulation names specific PI that is not authorized for disclosure to PEs or Non-PEs (e.g. counselling records).

Prescribing Requirements/Restrictions the Prescribed Body Must Comply with in Conducting Reviews Related to Determinations of Incapacity and Substitute Decision-Making under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Under Part X, consent for the collection, use and disclosure of personal information (PI) is based on capacity. The Consent and Capacity Board (CCB) is the proposed body to conduct reviews related to determinations of incapacity and substitute decision-making. The proposed regulation sets out the requirements and restrictions for the CCB's procedures in conducting reviews. The procedures will refer to existing procedures CCB operates under in the Health Care Consent Act (HCCA) sections 73-79.

Disclosure for Planning and Managing Services - Requirements for Non-Prescribed Entities or Persons on the Use, Security, Disclosure, Return or Disposal of Information under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Part X of the CYFSA establishes authorities for the Minister to collect, use and disclose personal information (PI) for specific purposes (e.g. planning and research). The Act also establishes authorities for service providers to disclose PI to non-prescribed entities or persons (Non-PEs) subject to certain requirements and restrictions for the purpose of planning and managing services. The proposed regulation further outlines requirements and restrictions related to these authorities.

Prescribed Reporting to the Information and Privacy Commissioner under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Part X of the CYFSA establishes rights for children, youth and families to have an oversight body (i.e. the Ontario Information and Privacy Commissioner (IPC)) to turn to if their personal information (PI) has been improperly shared or if requests to access or correct their PI held by service providers have been denied. The proposed regulation specifies what information service providers must provide to the IPC.

Prescribing a Body for Purposes of Capacity and Substitute Decision-Making Reviews under Part X (Personal Information) of the Child, Youth & Family Services Act, 2017 (CYFSA)

Under Part X of the CYFSA, consent for the collection, use and disclosure of personal information (PI) is based on capacity of an individual. The proposed regulation will name the Consent and Capacity Board (CCB) as the body prescribed to conduct reviews related to determinations of incapacity and substitute decision-making under Part X. The CCB is an independent provincial tribunal, whose mission is the fair and accessible adjudication of consent and capacity issues.

Low Carbon Transportation Fuels in Ontario: Amendments to Ethanol in Gasoline (O. Reg. 535/05) and Greener Diesel - Renewable Fuel Content Requirements for Petroleum Diesel Fuel (O. Reg. 97/14) Regulations  (source: Environmental Registry)

The Ministry is proposing to amend the Ethanol in Gasoline and Greener Diesel regulations to create an incentive for emerging renewable fuel technologies, require gasoline suppliers to maintain an average of at least 10% ethanol in regular grade gasoline (88 octane or less), by volume per calendar year and require ethanol used for compliance to emit significantly fewer (e.g. 35%) greenhouse gas (GHG) emissions on a lifecycle basis than petroleum gasoline starting in 2020.

The Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) proposes to replace, subject to the approval of the Legislature, Ontario's Fish Inspection Act and Ontario Regulation 456 - Quality Control with a new regulation under the Food Safety and Quality Act, 2001. The proposed changes would enhance food safety and result in a modern, outcome-based regulation to support the growth and competitiveness of the province's non-federally registered fish processors.
